1 There are difficulties in translating “the fact” because it sometimes refers to the action of a person and sometimes more generally to the fact. Although it is a person who works for another person under an employment contract (in the sense of an employment contract), it is broader and extends to other situations where there is a “subordination link”. The other part of such a relationship is called “employer,” which we translate as “employer”: see art. 1242. We reserve english “agents” to translate “agent”: cf. art. 1301, below.12`[A person subject to an order authorizing his family to act on his behalf” explanatoryly translates “the person the subject of a family authorization.” On this family of empowerment see Art 494-4 and following of the Civil Code, as inserted by ordinance No. 2015-1288 of October 15, 2015 on the simplification and modernization of family law.13We have translated “opposite” and its coded terms as “against.” The meaning of the French term is that a person (or, as in section 1156, not) can avail himself of a contract or other legal act against another person.
